Terms of Service

Last updated: 27 September 2026

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "user") and Tradepur Company, a brand of Kakushin Business Management Services ("Tradepur Company", "we", "us", "our"), governing your access to and use of tradepurcompany.com (the "Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Website.

2. Eligibility

The Website and our products and services are intended for use by individuals who are at least 18 years of age and who have the legal capacity to enter into binding contracts, whether on their own behalf or on behalf of a business entity they represent.

3. Nature of the Website

The Website is an informational and lead-generation platform for Tradepur Company's trading and services business, covering both goods (sourced locally and imported) and services (repair, civil, mechanical, electrical, installation, housekeeping, AMC, and logistics categories, among others). No products or services are sold, and no payments are processed, directly through this Website. All commercial transactions are agreed separately, through direct communication, formal quotation, and invoicing outside the Website.

4. Quotations, Orders, and Pricing

4.1 Any prices, availability, specifications, or lead times referenced on the Website or in preliminary communication are indicative only and do not constitute a binding offer.

4.2 A binding commercial arrangement is formed only upon our issuance of a formal quotation and your acceptance of it (whether in writing, by email, or by conduct such as payment or providing a purchase order), subject to any additional terms agreed at that time.

4.3 Pricing is subject to change based on quantity, specifications, site conditions (for services), prevailing market rates, and applicable taxes (including GST) at the time of order confirmation.

5. Payment and Invoicing

Payment terms will be specified in the relevant quotation or invoice issued for a confirmed order. All amounts are exclusive of applicable taxes unless stated otherwise. Invoices will be issued in accordance with applicable GST regulations, referencing GSTIN 09AUNPP8154B1ZB.

6. Delivery and Performance of Services

Delivery timelines for goods and scheduling for services will be communicated at the time of quotation and are estimates only, unless expressly agreed otherwise in writing. We will use reasonable commercial efforts to meet agreed timelines but are not liable for delays caused by factors outside our reasonable control, including those described in Section 11 (Force Majeure).

7. Accuracy of Website Content

We make reasonable efforts to keep product and service information on the Website accurate and current. However, category listings, item names, and descriptions are provided for general reference and browsing purposes only; exact specifications, availability, and pricing will be confirmed at the time of formal quotation.

8. Acceptable Use

You agree not to:

9. Intellectual Property

The Tradepur Company name, logo, brand elements, and the content, layout, and design of this Website (excluding any third-party trademarks referenced solely for descriptive purposes) are the property of Kakushin Business Management Services or its licensors. You may not reproduce, distribute, modify, or create derivative works from this content for commercial purposes without our prior written permission.

10. Warranties and Disclaimers

10.1 The Website and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.

10.2 Any warranties applicable to specific products or services will be as set out expressly in the relevant quotation, invoice, or written agreement for that transaction, and not as implied from general Website content.

11. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations (other than payment obligations) where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, earthquake, pandemic or epidemic, war, terrorism, civil unrest, riots, strikes, lockouts or other industrial action, governmental orders or restrictions, import/export or supply chain disruptions, power or internet outages, or failures of third-party service providers. The affected party shall notify the other party as soon as reasonably practicable and shall resume performance as soon as reasonably possible once the force majeure event ceases. If a force majeure event continues for more than 30 days, either party may terminate the affected order or engagement by written notice, without liability for such termination.

12. Limitation of Liability

12.1 To the fullest extent permitted by applicable law, Tradepur Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the Website or reliance on general information published on it.

12.2 Our total aggregate liability arising from any confirmed order or engagement shall not exceed the total amount paid by you for the specific goods or services giving rise to the claim, except where such limitation is not permitted under applicable law.

12.3 Nothing in these Terms limits liability for fraud, wilful misconduct, or gross negligence, or any other liability that cannot be excluded or limited under applicable Indian law.

13. Indemnification

You agree to indemnify and hold harmless Tradepur Company, its owner Kakushin Business Management Services, and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Website, violation of these Terms, or violation of any applicable law or third-party right.

14. Third-Party Services and Links

The Website relies on third-party service providers, including Hostinger (hosting, database and email), Google (analytics, advertising measurement and web fonts), and WhatsApp (if you choose to contact us there). Our Privacy Policy lists these providers and what each one receives. We are not responsible for the availability, performance, security practices, or content of third-party services, and your use of them may be subject to their own separate terms and privacy policies.

15. International Users

The Website is operated from India and is primarily intended for individuals and businesses seeking goods and services within India. If you access the Website from outside India, you are responsible for compliance with local laws applicable to you. We make no representation that the Website or our offerings are appropriate or available for use in all locations.

16. Termination

We reserve the right to refuse service, suspend, or terminate access to enquiry channels for any user who violates these Terms, engages in fraudulent or abusive conduct, or for any other reasonable business reason, with or without notice, to the extent permitted by applicable law.

17. Dispute Resolution

17.1 In the event of any dispute, controversy, or claim arising out of or relating to these Terms or any transaction between you and Tradepur Company, the parties shall first attempt to resolve the matter amicably through good-faith negotiation within 30 days of written notice of the dispute.

17.2 If the dispute is not resolved amicably, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator mutually appointed by the parties, with the seat and venue of arbitration in Delhi, India, and proceedings conducted in English. This does not preclude either party from seeking urgent interim relief from a court of competent jurisdiction.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to Section 17 (Dispute Resolution), the courts at Delhi, India shall have exclusive jurisdiction over any matters not resolved through arbitration or requiring interim judicial relief.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any formal quotation or written agreement governing a specific transaction, constitute the entire agreement between you and Tradepur Company regarding your use of the Website, superseding any prior understandings relating to the same subject matter.

21. Waiver and Assignment

No failure or delay by either party in exercising any right under these Terms shall operate as a waiver of that right. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of business assets.

Any formal legal notice to Tradepur Company should be sent in writing to the Corporate Office address or email address listed in Section 23. Notices to you may be sent to the contact details you provide to us.
